3.1 Information Collected

Our services require us to authenticate and know who you are, so that we can best meet your needs. When you access the services, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you. Without prejudice to the generality of the above, information collected by us from you, while you create an account for yourself on the Polyglaze Partner Connect application, may include (but is not limited to) the following:

• Name, address, mobile number
• Bank details
• Data regarding your usage of the services.

This information collected from you by Polyglaze Partner Connect may constitute ‘personal information’ or ‘sensitive personal data or information’ as defined under Rule 2(i) and Rule 3 of the SPDI Rules. Information that is freely available in the public domain or accessible under the Right to Information Act, 2005 or any other law will not be regarded as personal information or sensitive personal data or information.

3.2 Collection of Location-Related Information

Our services also require us to collect location-related information such as your current location, where you live, the places you visit, the businesses and people you’re near, etc. (“Location Data”) since our user-engagement is location-based and it will help us support you and connect you with stores, sales and technical staff, etc. Further, the offers and benefits offered on Polyglaze Partner Connect are also location-based and would not function in the event the collection of location data is not allowed.

Your location can be determined with varying degrees of accuracy by:

• GPS and other sensor data from your device
• IP address

It is clarified that collection of Location Data by Polyglaze Partner Connect is optional and you can choose to disable tracking of Location Data by Polyglaze Partner Connect by revoking your consent through your device’s settings. However, in the event, collection of Location Data is disabled, you will not be able to enjoy various services and benefits of Polyglaze Partner Connect.

4.1 Consent to the Privacy Policy

By affirming your assent to this Privacy Policy, you provide your consent to such collection as required under applicable law.

4.2 Purpose and Use of Information Collected

All/any information provided by you, including sensitive information and Location Data is voluntary and we reserve the right to use such information provided by or about you for the following purposes:

• Publishing individual’s information on Polyglaze Partner Connect. This information is accessible only by the individual who has generated this data on his/her own or through Partners.
• Contacting you for taking product and service feedback.
• Analyzing software usage patterns for improving product design & utility.
• Help promote safe services.
• Inform you about offers, products, services, updates, customize your experience, detect & protect us against error, fraud, and other criminal activity, enforce our terms and conditions, etc.
• To send you offers, product information, events, educational information, etc. based on your previous orders and interests.

4.3 Disclosure of Information

Polyglaze Partner Connect takes your right to privacy very seriously and other than as specifically stated in this privacy policy, we will only disclose your personal information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority, or similar requirements or when Company, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.

4.4 Statistical Information

We also reserve the right to, periodically, reveal general statistical information about Polyglaze Partner Connect & its users, such as the number of visitors, the number and type of goods and services purchased, etc.

4.5 Your Duties

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your personal information changes, you may amend the information by making necessary changes wherever possible or by contacting us through support. If you wish to make changes to the bank details provided by you, kindly contact us by calling the helpline number provided. We will make the requested changes in our then-active databases as soon as possible. If you provide any information that is untrue, inaccurate, out of date or incomplete, or Polyglaze Partner Connect has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, Polyglaze Partner Connect may, at its sole discretion, discontinue the provision of the services to you.

If you wish to cancel your account or request that we no longer use your information to provide you services, contact us through support. We shall not retain such personal information unless required under any other law for the time being in force.

5.1 Maintenance of Personal Information

Your Personal Information is maintained by Company in electronic form on its equipment, and on the equipment of its employees. Company takes all necessary precautions to protect your personal information both online and offline and implements reasonable security practices and measures including certain technical, operational, managerial, and physical security control measures that commensurate with respect to the information being collected and the nature of Polyglaze Partner Connect business.

5.2 Unauthorized Use

Company will not be liable for any unauthorized use of your account. If you suspect unauthorized use of your account, at any time, you must immediately notify Company by contacting support. You shall be liable to indemnify Company for any loss suffered by us due to such unauthorized use of your account.

5.3 Information Accessibility

Company makes your information accessible to its employees, agents, or partners and third parties only on a need-to-know basis and binds all such parties to strict confidentiality obligations.

5.4 Responsibility

Notwithstanding the above, Company is not responsible for the confidentiality security or distribution of your personal information by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, Company shall not be held responsible for any breach of security or for any action by third parties or events that are beyond the reasonable control of Company including, acts of government, computer hacking, unauthorized access to computer data and storage device, system failure, breach of security and encryption, poor quality of your Internet service or mobile phone service, etc.

a. Age Requirement

You must be 18 (eighteen) years or older to visit/register with Polyglaze Partner Connect. By registering and using the services you agree that you are eighteen years or above and you are not barred by any law to contract and you agree to have read and accepted the terms and conditions provided herein. We are under no obligation to accept a request for registration.

b. Account Creation

You may access the Platform by registering to create an account (“Polyglaze Partner Connect Account”) by providing your full name and mobile number, pursuant to which you shall receive a One Time Password (“OTP”) as an SMS on the mobile number provided and inputting the OTP on the Platform, you may become a member (“Membership”).

c. Communication

By registering your mobile number with us, you consent to receive, via phone calls or SMS notifications subscription/service updates/information in relation to events, promotions, etc. You have the option to "opt-out" of receiving future communications or request for your name to be deleted from our mailing lists by contacting the email address given below. We do not guarantee that all communications sent by us will be delivered in their entirety to you. You acknowledge that you are responsible for all charges and permissions required for accessing our Platform through your mobile network provider.

d. Accuracy of Information

You agree to provide accurate and complete information about yourself while registering on Our Platform as a Member and ensure to promptly update your registration data to keep it up to date and complete. In the case, we are unable to establish your unique identity against a valid mobile number, your account shall be indefinitely suspended.

e. Single Account

You are permitted to have only one Polyglaze Partner Connect account at any given point in time. If you fail to comply, we reserve the right to suspend such multiple accounts without being liable for any compensation.

f. Data Disclosure

We reserve the right to disclose to third parties certain data, not including personal data, related to You. If we are required to share your personal information, (1) You may expressly permit us to do so or (2) we are bound to share such personal information by way of any applicable law or legal process.

g. Account Suspension

We reserve the full discretion to suspend your account in the event you fail to comply with any of the terms mentioned herein and do not have any liability to share any account information whatsoever.

a. Platform Services

Polyglaze Partner Connect provides a number of internet-based services through the Platform like scanning a QR code, redeeming cash pursuant to a claim code upon the purchase & scan of a product, checking the balance of the cash available for you, redeeming the cash, providing product information, help centre, etc.

b. Coupon Code

Product purchased by you may contain a coupon with a coupon code printed on it along with a QR code. You represent and warrant that you have purchased our product and therefore are entitled to use the coupon code. The coupon code is non-transferable.

c. Scanning QR Code

Upon becoming a Member, you must scan the QR code and the corresponding cash shall be credited to your account wallet.

d. Cash Not Received

If in a transaction performed by you on the Platform, the cash has not been received in your bank account within 7 working days, then you shall inform us by sending an email to our customer services email address.

a. Bank Details

In the event that you wish to redeem the cash into your account, you will be required to provide your bank account details like name, bank name, branch details, IFSC code, and account number or UPI ID. This information will be treated as personal information and governed by the Privacy Policy. You represent and warrant that the information provided is current and accurate. Company will not be liable for any discrepancies and consequent losses or damages.

b. Misuse or Theft

In the event that there is any misuse or theft of handheld devices, you are required to inform us to suspend the account and prevent the changes of any personal information on the Platform.

c. Compliance

In the event that any KYC information or other compliance required under law is required from you to complete the cash policy, you agree to provide the same as per the timelines mentioned.

a. Prohibited Actions

You shall not directly or indirectly do or cause any action, on the Platform, which:

• Promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous, including a photograph of another person that you have posted without that person’s consent or otherwise constitutes an invasion of an individual’s privacy or infringement of publicity rights.
• Involves commercial activities and/or sales without Company’s prior written consent, such as contests, sweepstakes, barter, advertising, and/or pyramid schemes.
• Provides any telephone numbers, street addresses, last names, or email addresses of anyone other than your own.
• Solicits passwords or personal identifying information from other Users.
• Harasses or advocates harassment of another person.
• Involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”.
• Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses.
• Is offensive and/or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.
• Exploits people in a sexual or violent manner.
• Contains nudity, violence, pornography, sexually explicit material, or offensive subject matter.

b. Impersonation

You shall not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

c. Unlawful Use

You shall not use the Platform or any content on the Platform for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity that infringes the rights of the Company.

d. Defamatory Statements

You shall not make any negative or defamatory statement(s) or comment(s) about us or our domain name or the name of Polyglaze Partner Connect or engage in any conduct or action that might tarnish the image or reputation of Company on the Platform or any social media platforms or otherwise tarnish or dilute any Company trade or service marks, trade name and/or goodwill associated with such trade or service marks, as may be owned or used by us.

e. Automatic Devices

You shall not launch any “page-scrape”, “deep-link”, “spider”, “robot”, or other automatic devices, programs, or code, etc. to access, copy or monitor any portion of the Platform, to acquire or attempt to acquire any materials, documents, or information through any means not intentionally available on the Platform. We reserve our right to prohibit any such activity and suspend your account immediately.

f. Load on Infrastructure

You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform or Company’s systems or networks.

g. Unauthorized Access

You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, “password mining” or any other illegitimate means.

h. Interference

You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform.

i. Compliance

You shall at all times ensure full compliance with the applicable provisions, as amended from time to time.

a. Accuracy of Information

Company does not warrant or represent that the material on the platform is accurate, complete or current or that the website will be free of defects or viruses.

b. "As Is" and "As Available" Basis

All the materials and products (including but not limited to software) and services, included on or otherwise made available to you through Platform are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing.

c. Limitation of Liability

We shall not be liable to you or anyone else for any losses or injury arising out of or relating to the information provided on the Platform. In no event will we or our employees, affiliates, authors or agents be liable to you or any third party for any decision made or action taken by your reliance on the content contained herein.

d. Third-Party Services

You acknowledge that third-party services may be available on the Platform. We may have formed partnerships or alliances with some of these third parties from time to time in order to facilitate the provision of certain services to you. However, you acknowledge and agree that at no time are we making any representation or warranty regarding any third party’s services or products nor will we be liable to you or any third party for any consequences or claims arising from or in connection with such third party including, and not limited to, any liability or responsibility for death, injury or impairment experienced by you or any third party. You hereby disclaim and waive any rights and claims you may have against us with respect to third party’s / merchants’ services.

e. Indirect, Punitive, Incidental, Special, Consequential Damages

In no event shall Company be liable for any indirect, punitive, incidental, special, consequential damages or any other damages resulting from:

• The use or the inability to use the Platform, services, products
• Unauthorized access to or alteration of the user's transmissions or data
• Breach of condition, representations or warranties by the manufacturer of the Gift or the products displayed on the Platform
• Any other matter relating to the services including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Platform or service. Company shall not be held responsible for non-availability of the Platform during periodic maintenance operations or any unplanned suspension of access to the Platform. Any material and/or data downloaded from the Platform is solely at Your own discretion and risk and You will be solely responsible for any damage to your mobile or loss of data that results from such download. To the maximum extent that is permissible under law, Company’s liability shall be limited to an amount or Rs. 100/-

a. Termination by User

If at any time you wish to terminate your registration as a member, kindly notify us of your intention by sending us a mail to the e-mail id given hereunder.

b. Termination by Company

Company reserves the right to suspend or terminate your use of Polyglaze Partner Connect, if we believe, in our sole and absolute discretion that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Use or anyway otherwise acted unethically. In such an event, all cash that has been accumulated by you shall stand forfeited and you shall not be entitled to any compensation or redemption of any accumulated cash.
